Labor Dismissal: Worker Rejects Unapproved Settlement Deal

A worker dismissed by Avatel Telecom received a severance package of €11,284 and successfully had her settlement agreement annulled. The Tribunal Superior de Justicia de Andalucía ruled that the labor representative lacked authorization to waive future salary claims beyond the dismissal indemnity. Although both parties signed an accord in October 2024 extinguishing their employment relationship with a lump sum payment, it included clauses surrendering rights to additional economic demands such as seniority pay. The worker challenged this pact because her legal advisor accepted terms without sufficient mandate for those specific negotiations.
