German Bundestag Lifts Immunity and Plans Prosecution of AfD Politicians over Social Media Posts

The Lower Saxony State Parliament has lifted the immunity of AfD politician Vanessa Behrendt amid investigations into her social media posts. The Göttingen Public Prosecutor's Office plans to file charges against Behrendt for incitement to hatred (Volksverhetzung), defamation, and other related offenses, based on posts she made on the platform X (formerly Twitter) between August 2024 and February 2025. Behrendt claims the charges are politically motivated and aims to portray her as a martyr, criticizing the legal process as a 'farce.' The parliament's decision to remove her immunity was supported by some members but abstained by her party, the AfD, which expressed concerns about increasing politicization of legal actions against its members. The case involves allegations that Behrendt called the rainbow flag a symbol of pedophile lobby groups and made derogatory remarks about queer individuals, including comparing them to sexual offenders. Critics from other parties, such as SPD and Greens, condemned her comments as offensive and harmful to minorities, emphasizing that parliamentary immunity is meant to protect legislators from undue influence and legal harassment. This is the sixth time in this legislative period that immunity has been lifted from an AfD member. The investigation highlights ongoing tensions in German politics regarding freedom of speech, minority rights, and the limits of parliamentary immunity.
